Leanne: Good afternoon Mr. Golding. Mr Golding:Good afternoon to you. Leanne:As we all know, Lord of the flies is about lots of boys trapped on an island. What was the reason of putting just boys on the island? Why were there no girls? Mr Golding:At the time of the book, it was the war. Fighting and arguing was going on around us, and it seemed as though nobody was really sane anymore. It started off as being happy and positive, and ended up being complete madness. Women were at home, doing the housework, cooking food, you know? They didn't really have a choice in anything. To be fair, they didn't really have much of a part in everyday life. This is the image that I tried to portray on the island. I felt that if I'd have put girls on the island, the book would not have been so action-packed. Girls have a strange habit of making the atmosphere a lot calmer, and I did not want this. I also felt it would be hard to know the characters of girls. As a writer, I feel it is essential to know your characters well, and because I was a little boy, I do not know how a little girl would have felt at that age. I wanted my characters to be believable, and by putting girls on the island, I don't think I would have achieved this. I also realised that girls go through many problems when they are growing up, and I wanted my story to be an action one, not one full of relationships, I e boys and girls. I don't think that the island I wanted to create would have catered for their teenage needs, shall we say. Leanne:Yes, I understand. Th... ...ph is his only friend. Leanne: Ah. Poor Piggy! Why did you put the Beastie idea into their heads? Mr Golding: Well I figured that by having young boys on an island, there would be an element of fear. The most important part of the chapter is when young Simon stands up and tells the group that the Beastie is them. They are scared of themselves because of what they have slowly turned into. The boys would obviously have been scared in the night, but I specifically wanted the reader to know that the older boys were turning into terrifying monsters that the little boys couldn't handle anymore. They were bloodthirsty scavengers, who just wanted to kill. This was making the young boys insecure. Leanne: Well, Thankyou very much Mr. Golding. That was both very interesting and informative. Because employees tend to spend so much of their weekday hours on the job, they often are tempted to conduct personal business on company time. This can include setting up doctor’s appointments on company phone lines, making vacation reservations using their employer’s computers and Internet connections or even making phone calls for a freelance side business while on company time. At first glance, this ethical dilemma is fairly clear: It is an abuse of your employer to conduct personal business on company time. But there are shades of gray here. What if your spouse calls to tell you that your children are ill? Is it OK for you to schedule a doctor’s appointment? A good rule of thumb is for an employee to check with his manager or human resources supervisors to clarify what counts as an actionable offense in the company. Taking Credit for Others’ Work Employees often work in teams to create marketing campaigns, develop new products or fine-tune services, yet rarely does everyone in a group contribute equally to the final product. If three members of a five-person team did all the work, do those three members demand to receive proper credit while pointing out that two members of the team did not pull their weight? This is a thorny question. If employees single out their co-workers in a negative light, it could foment resentment. The same thing could happen, however, if all employees accept equal praise even though only a select few did the real work. The best way to resolve this ethical dilemma is to not let it happen. Team members should insist that all employees perform specific tasks to help complete a project. Harassing Behavior Employees often don’t know what to do if they see one of their co-workers harassing another employee, either mentally, sexually or physically. Employees may worry for their jobs if they attempt to report a superior for harassment. They may fret that they’ll be labeled a troublemaker if they report co-workers who display inappropriate behavior toward other employees. The best way to resolve this ethical dilemma rests with the staff members who develop the company’s employee handbook. It is their job to include specific language that spells out that employees won’t be punished for reporting the harassing behavior or inappropriate actions of their co-workers.

Examine how Shakespeare presents the female characters in ‘Hamlet’ and what the response of a modern day audience might be to this aspect of the play. As ‘Hamlet’ was set in the Elizabethan period it is necessary to consider the portrayal of woman in the play as a comparison with women in a modern day society. Similarly to most literature written during this period, ‘Hamlet’ conveys women’s lower status to men. This can be thought of as the stereotypical view in Elizabethan society. We know that women were not even able to act in plays and that young men had to play the parts of women. One of the main ways we may interpret the portrayal of woman is through the language, and in some cases stage directions of various characters, in various scenes. It may be true to say that the characters of Ophelia and Gertrude are portrayed as weak and submissive, this is seen by men as well as themselves. They can be seen to be merely driving factors of the play rather than main elements such as Hamlet. It may also be suggested that due to these facts, the play ‘Hamlet’ may be written differently if written today, in terms of language, in order to suit a modern day audience. It can be argued that the way Shakespeare has presented women, reflecting society in the Elizabethan period, may not be acceptable in today’s society. One of the principle aspects to consider is how female characters are portrayed and therefore treated by others in the play. Ophelia is an interesting character, and it is important to explore her relationships, her language, and also her death prior to concluding her portrayal. This may be noticed in her relationship with the men in her family. In Act one, the relationship shared between Polonius, Laertes and Ophelia may be compared. When looking at Polonius’ relationship with his daughter it may be noticed that he is not quite as willing to give in to her wishes. Instead he gives her strenuous warnings about how to behave in relation to Hamlet. â€Å"Do not believe his vows, for they are brokers†, Polonius tells Ophelia not to believe what Hamlet says to her. . However, he does show his concern for her, because he is warning her to be very careful in this business. Polonius forbids Ophelia to associate herself with Hamlet, telling her that he is deceiving in his declaration of love. It is extremely doubtful that he is simply doing this to deny her of what she wants; however the audience becomes aware of the domination and power he has over his daughter. Another view is that daughters were merely supposed to bring fortune and honour to the family and that Polonius may have been more concerned about his reputation, rather than the happiness of his daughter. Ophelia dutifully obeys her father, responding minimally with â€Å"I shall obey, my lord†. This type of attitude was thought of as normal in the Elizabethan times. It must also be noticed that the protective role of a father over his daughter, and a brother over his sister would not be thought of as abnormal in today’s society. It is the extent to which this protectiveness is present, and the fact that Ophelia shows no intention to disobey their wishes, that would both surprise and amaze a modern day audience. The extent of domination, particularly over a daughter’s personal matters such as marriage would be normal in Elizabethan times. However, similar to today, a father would not be as protective over his son as he would over his daughter. Earlier in Act 1, Laertes warns Ophelia about Hamlets love, describing it almost as youthful infatuation. He explains to her that as Hamlet is a prince he cannot choose his own wife and must marry in the interest of the state. Again, this type of advice and awareness of status would not be criticised by a modern day audience. Laertes’ approach is indeed blunt, and Ophelia is told directly not to be so foolish as to trust the Prince outright. Ophelia says that she will keep his advice as a â€Å"watchman† close to her heart â€Å"I shall th’effect of this good lesson keep as a watchman to my heart†. She hints to him that he should not give her advice that he does not follow himself. â€Å"show me the steep and thorny way to heaven†, â€Å"himself the primrose path of dalliance treads†.

As such, it can be translated to English in a variety of ways, depending on the context: to earn, to win, to reach, to defeat, to improve. Ganar is a cousin of the English gain and sometimes has that meaning as well. Using the Noun Form Gana Although you might expect that the noun form gana would refer to earnings or gains, it instead refers to the desire or appetite for something. Etymology of Ganar Unlike most other Spanish verbs, ganar probably isnt of Latin origin. According to the Royal Spanish Academys dictionary, ganar possibly came from a Gothic word ganan, which meant to covet, along with Germanic and Nordic influences from words related to hunting, harvesting and envy. Ganar and the English gain may be related to an ancient Proto-Indo-European root referring to striving.

Other animals or birds which appeared in the images were also scrutinized. Depth data were analyzed with a behavior analysis program.

Most of all, the picture could easily be a routine snapshot taken for identification documents as it does not create an impression. Interestingly a suggestive ad for sex therapy sits alongside the victim’s picture. In any case, the rather bland picture of the victim and the continuous informal use of her name throughout the article come s across as an intention to present an average, somewhat unsympathetic individual. The term â€Å"average Jo† invariably comes to mind and could either create sympathies or create detachment. A picture of the suspect’s mother and brother also appear on the last page of the article, but with far less ambiguity than the picture of the victim. The image captures drawn and saddened faces, under which the caption reads: â€Å"Angry†¦mum Sonja and brother Marcel.† The article in The Times is more cohesive in its layout in that it tells a story that is easy to follow. The connection begins with a caption that clearly directs attention to the content of the article. The caption reads: Yeates Parents Tell of â€Å"Enormous Relief† at Murder Charge. Thereafter, the article reads like a narrative with facts integrated to ensure that the reader knows why the Yeates parents relieved. For instance, upon informing the audience that the parents of the murder victim are relieved, the writer immediately names the suspect, and identifies him as a neighbour of the victim and reveals that he was arrested and will be formally charged with their daughter’s murder. The article appearing in The Sun however, is not as cohesive and as such it is more difficult to follow. The caption itself is confusing and reads: Girlfriend: I Stand by Jo Accused. Unlike The Times, the language in The Sun’s caption is informal and does not read like a complete sentence. The reader’s curiosity is therefore aroused immediately, although the opening lines to the article dispels that curiosity by informing who Jo is. The hats of the day included three-cornered hats, large, flat hats that were carried under the arm, and two-cornered hats.   Men wore caps instead of wigs at home.   Common styles for the cap was a cap with a round crown and flat, turned-up brim that fit close to the crown.   Women in the eighteenth century wore simple hairstyles that replaced fontage styles.   Hair was generally waved loosely around the face and twisted up into a small bun on top of, or in back of, the head.   For formal occasions, women sometimes powdered their hair.   Women’s hats for indoors included pinners, circular caps with single or double frills around the edge, worn flat on the head, mob caps with wide, flat borders that encircled the face with high, puffed-out crowns located toward the back of the head. Lace trimming was often used, and indoor hats could be worn outdoors under other hats.   Outdoor women’s hats included hoods, small silk or straw hats with narrow ribbon bands and narrow brims. The technology that was developed that related to clothing during this time was advancements in the textile industry that expanded textile availability and lowered costs. The costume design could be inaccurate. One such field is that of entertainment. Be it music, videos, video games or even sports, techno- science has ensured that electronic gadgets have been created, thereby improving peoples lives. The chief beneficially to technological advancements in entertainment is children and young adults/adolescents. Video games are a top mode of entertainment among this young group of people. Video games are the creation of computers, and while even adults play these games, the market segment is children and young people. However much technological advancement are on the rise, techno-scientists have been accused of creating products without having to care about the potential effects of these products to the market segment. For instance, violent video games are immensely entertaining to children and young people, but what is puzzling is that, innovators of these products do not have the slightest care concerning the effect that these games have on the users (Anderson Bushman, 39). Video games were created as a mode of entertainment by all age groups, but the principle market segment is children and teenagers who spend most of their free time indoors. These games have been seen as a way of enhancing the creativity and learning abilities of children, and are recommended for parents for their children. The popularity of action-hero movies triggered video game manufacturers to inject a new perspective into video games; violence. By doing this, they hoped to grasp larger audiences and entice younger ages more with their products. This was a marketing tool that was meant to revolutionize their business and make it more real. In these games, the users take the form of action-heroes who engage in violent confrontations with others. These heroes must keep winning duels so that the game advances to the next level. This pumps the adrenaline in game users until they become addicted as they want to advance to the next level and be winners in these violent duels. To the manufacturers, video games are created to entertain and please the users, but apart from entertaining them, violent video games have been accused of behavioral modification especially in young users by giving them aggressive and violent traits. In an era where action movies and thrillers fascinate young people and adults alike, video game manufacturers are taking advantage of this craze by coming up with video games with an injected bit of violence. The problem that has cropped up is that, video games being mostly used by children and young teenagers influence the behavior of this group of people. An adult views these games as a form of entertainment, but to a young person, it is both entertainment and a site to mimic behavior. While adults and senior teenagers play violent games, they do not seem to be affected much due to their perception. While an adult sees these games as a way of entertainment, a child may not understand why someone goes around the street shooting others or causing bodily harm to others. To them, it seems normal, and with this perception, behavioral modification is bound to occur. These children easily become aggressive and engage in endless confrontations with their peers. The debate concerning violent video games and ways in which they lead to aggressive behavior has been around for years. A study by Gentile, lynch, Linder and Walsh (2004) has shown that relative growth of these games has made American teenagers more aggressive in nature and to have terrible behaviors and attitudes. In this study, research was carried out from six hundred and seven students from four schools to confirm the violence that these games bring out in pupils attending the eighth grade. Teenagers who were exposed to many video games of a violent nature were reported to be hostile, and they could get into arguments with teachers easily and more frequently. They were involved in physical fights with fellow students at a higher rate and were poor performers in school. By comparison, violent video games bring more harm than violent TV programs. Unlike TV watching, playing video games is more involving and engaging. Whenever someone plays as a violent character in a video game, they try to identify with that particular character. In case they play as the same character over and over, it is easy for these traits to be transcribed into their behavior (Deselms and Altman, 1562). Finally, when players play as violent characters, they are awarded bonus points or, they advance to the next level. This motivates them to continually take part in these games. They become obsessed with the characters, and it can easily lead them in committing a crime. Sales of video games in America have risen over the years with the electronic entertainment market raking more than seven billion dollars back in 1999. This surpasses the revenues of film production for the first time in American history. The sales have surpassed twenty billion American dollars. This has been fuelled by the existence of more than 200 million game boys and 80 million play stations that have been sold on the video game market. An average American kid from age 2 to 17 is able to play and stay on a video game for 7 hours or more in a week. This masks the enormous difference between the girl child and boy child with different ages. A recent study by Anderson et al in 2010 established that most teenage girls engage in these games for more than five hours in a week while boys do it for more than thirteen hours in a week. This is an average playtime of nine hours in a day that teenagers spend on games. Studies have been conducted over the last 25 years, and most of them have looked at the final effects of video games of teenagers (Anderson and Bushman, 449). Most of these studies have managed to outline a link between these violent games and aggression. Some have even gone further by determining how video games affect school performance, and what has been established is that school performance has been compromised as a result of video games. This is a tremendous setback on the American education since the numbers of such students is on the rise. The impact of violent video games extends even to institutions of higher learning as evidenced by research done by Gentile, lynch, Linder and Walsh in 2004. In their research, they established that there are negative impacts in college students who spend most of their leisure time on violent video games instead of concentrating on studies. The grades of these students have been reported to drop drastically and they attain aggressive behavio r. Study Review Video games have been in existence for the past 30 or so years. Video games have become so sophisticated to the point of ensuring that the player must pay close attention to what is going on. While video games have positive and negative effects, empirical studies continue showing that there are more drawbacks than advantages, especially by contributing to aggressive behavior in people, especially children and young teenagers. Studies have shown that aggression in children and young people is determined by the time spent by playing these games. For example, a study by Walsh in 2000 revealed most teenagers have admitted that their parents do not impose time limits on the hours they use to play video games. A good number of parents also take no notice of the content of games that their children play. Therefore, the long playing hours coupled with parents profligacy in imposing their monitoring has made the teenagers aggressive. Another study by Gentile, lynch, Linder and Walsh in 2004 subjected adolescent boys and girls to long periods of video games. These researchers proved that, young people who engaged in violent video games for an extended time period are more aggressive, engage in constant confrontations and score low school performance (Gentile et al, 21). Another study finding reveals that aggression develops in game users when they engage in games that are beyond their level. Games are accorded leve ls corresponding to particular age groups. This needs to be followed because; young children may play games that are many levels ahead. These children happen to witness shocking scenes to a point that their young minds become affected. These children easily become aggressive. Picture a modern video game about an assassin who is going around the street killing rival gang members. When a child or any young person mimics the assassin in the game, images of such a video game are inscribed in this their mind, and they are for sure going to become more aggressive. The child first starts mimicking the shooter with even sticks, and later they become aggressive. In most video games, players progress to the next round, and the more they play, the more they become addicted, and they more aggressive they are likely to get. Empirical data has shown that violent video games supersede even violent films (Pollard et al, 10). The results of the study confirmed that people who engaged in violent video games became more aggressive when compared to those who were merely watching. While a few people assert that violent games are harmless, studies continue to show the opposite. There is evidence that violence video games make the players cathartic in that, they vent their angers aimlessly. In their work, Anderson et al (2010) assert that approximately 130 researches have been conducted on the same topic using over 130,000 subjects and the study findings were that; violent video games enhance aggressive thoughts and behavior, and increase ones physiological arousal by increasing ones pulse and blood pressure. Anderson and Bushman conducted extensive research in 2002, and from that, they were able to come up with evidence for the topic in question. The research was aimed at investigating the link between media violence and aggression. From their study, it was revealed that players who continually engage in violent video games become aggressive since violent behavior is repeated in the games over and over. Besides, video games ensure that players are active participants instead of being passive as in movies. Moreover, players in video games identify with a particular character they adore. This is what is known as the first person video game (Anderson Dill, 788). From this, players imitate the characters of these video games, which trigger them to become aggressive. For instance, a player who engages in a violent game develops aggressive thoughts. In their study, bushman Anderson concluded that when a player who was previously exposed to violent video games encounters confrontation, they r espond with an enhanced rate of aggression. However much scientific evidence has shown that video games that are violent cause aggressive behavior especially in young people; other theorists have opposed this citing various reasons. For instance, people who engage in violent video games have claimed that even though they play video games, they have never killed anyone. This is true especially from the United States FBI murder figures for 2010. From the survey, it was revealed that the murder rate in the US per year is 6 in 100,000. This is a low rate implying that murder from events like violent video games is highly unlikely. But this does not mean that violent video games do not lead to aggression. Secondly, the media have contributed to the denial that violent video games do not cause aggression. This is because; media personalities have failed to admit that the product they are marketing is dangerous. This is analogous to the tobacco industry; even though the manufacturers of tobacco know that the product is harmful, they have been reluctant to admit that their product is harmful. The role of parents in curbing aggression in their children cannot be underemphasized. Psychologists have identified that parents have a role of cautioning their children concerning violent media. Stopping your children from engaging in violent video games is unrealistic as a person is not able to supervise all the time, but it is necessary to regulate what children engage in. There are many ways parents can help (Pollard et al, 89). For one, they need not install violent media at home. Secondly, parents need to know the rating of all video games available at home, so that young children do not play games way above their level. The effects become harmful when parents who are supposed to monitor their children when they engage in these games become careless and leave the children to continue playing video games without limit. The endgame with this is that the child starts to be a psychopath and is likely to try and experiment what was being played in video games on the real world. The child will start to be aggressive when offended in a small way and may hurt everyone in the vicinity. Electronic media have the probability of enlightening the social and learning behavior of students by replacing reading activities, time for family interactions and social time with friends. If an average child spends 7 hours in a week to engage in these games, the child is not able to engage thems elves in any form of homework or reading. This results to the child becoming lazy and stubborn which may increase the aggressive nature of the child. Summary of Findings From the analyses of various studies and researches made, it is evident that more boys engage in violent video games than girls. Those who engage also acquire aggression with time, which leads them to engage in confrontations in school and landing in trouble in most times. These young individuals also grow up into aggressive people when their game time is excessive. Many researches also shows that, a majority of parents do not monitor their children and teenagers on the game time, making some young game players overindulge in violent games. A majority of parents also do not check the rating of the violent games, which allows even younger children to access games that are beyond their level. Study Interpretation Content analysis carried out by Walsh (2000) shows that more than 90% these games in the American market have some form of a violent nature and more than 60% in the global market have serious violence amongst those who take part in the game. The study concludes that a good proportion of games bought by gamers contain serious violence and the popularity of this form of games is mostly determined by the violence content that is developed among the characters. Pollard, Bushman Anderson in their 2011 research found out that, violence has spurred a lot among adolescents and children; this violence is mostly a result of violent video games. Bushman and Anderson (2002) conducted a Meta-analysis of 54 tests, which were independent about the relation between the violence of video games and physical aggression. This analysis involved more than four thousand participants and five results, which were consistent, among these gamers in relation to violent video games were derived from the analysis. Playing of violent games increases the aggressive cognitions of the participants. Violent games increase the arousal, physiologically aggressive emotion is increased by playing such games. Aggressive behaviors are increased among the gamers, and the pro- social behavior of the gamers is decreased with immediate effect. These effects termed as robust, and they are found in all ages of people in society, be it adults or children, females or males and non-experimental and experimental studies. Most of studies have been done out and results found with more than sufficient evidence that explains about the impacts of violent video games, b ut so far little has been done to avert this problem in the American society. Age restrictions have been imposed on accessing different kinds of video games with certain levels of violence, but somehow the young people end up getting the games from sources that are unclear. Gamers who are born aggression seem to have increased violence while and after playing video games of a violent nature. A study by Gentile, lynch, Linder and Walsh (2004) found that the physiological impacts of engaging in these games is worse in children who had developed a violent nature before they started playing video games than those who have no violent traits. These children are more likely to start excising the violent activities that they experience in video games, in real life. Gamers with the violence trait from birth showed increases in epinephrine levels in their blood and their arterial pressure increased too. This was the reverses of the gamers who did not have this trait. Moderation In moderating people who have the violent trait, parents and guardians should be able to notice this issue earlier when the child is growing up, and they should be able to help the child by restricting video games of violence nature. Children with this trait are not supposed to be exposed to any violence at all as they have a high probability that they will imitate the violent conditions that they experience. Parental monitoring should be able to play a significant role in ensuring that the children are safe, and they do not interact with violent videos. Instead, parents should ensure that they buy their children video games of an educational nature to motivate their children to think out of the box and increase their studies. When parents impose limits on television, the children tend to understand, the same should be done on video games and give children tight rules on accessing the games. Parents should be active in promoting positive messages that are brought with the entire vide o games and shun the negative messages conveyed by the violent video games. They should be the role models and convey a positive message to their children. Gentile and Walsh (2002) carried out a study about the ability of parents to input their control on video games that are accessed by their children. More than 55% of the parents allowed their children to take play video games of their choice including the ones that have a violent nature. 40% of the parents have the ability to control what their children play, they have the ability and responsibility of checking the regulations of the game before giving the children the opportunity to play, and 5% of the parents are never at home, so children are free to engage in any form of games of their choice and desire. This study shows how most of the parents have underestimated the damage that these games are doing to their children and perhaps it is because most of the parents nowadays are workaholics and do not have adequate time to be with their children and know about their lives. Some of the parents are not even able to name the game type that their children are playing which most childre n take advantage of since the parents are not concerned to know what the favorite things their children like. If only parents could step up and become active in the moderating process of these video games, then it is highly likely that the children could be saved from becoming aggressive. Active parents also know what to do when their children are not performing according to standards in school. They are able to consult with teachers and tutors so that the child is given additional motivation that is required to perform better in studies. Conclusion The importance of innovation is that it makes life enjoyable and modernized. One such aspect of modern innovation is the advent of video games. Video games have revolutionized the entertainment industry. It is entertainment for all age groups as one can relax and pass time especially during ones free time. Even though they are used by all age groups, the target market segment is young children and teenagers. Manufacturers of video games target the young market segment as they are the group that is easily enticed and enthralled by games, and one that can spend almost the whole day playing the games if it were possible. Children and teenagers of the modern world are spending much of their free time playing these games, unlike adults who have an aspect of moderation in video game playing. Despite teenagers and children spending most of their time engaging in video games, these games have a positive attribute in their development. These games are seen as a way of improving the reasoning and intelligence of children, and for this reason they are encouraged in all home settings. Through these games also, parents are able to occupy their children during the free time. Therefore, instead of engaging in mischief and wandering about the neighborhood, video games engage children by keeping them busy. As they are addictive, children remain glued to their seats playing these games. Despite technological innovations making life easier and better, one major problem associated with them is that, techno-scientists are obsessed with furthering their innovations to the point of coming up with principles that are bringing more harm than good to the users. When a product is liked in the market segment and the sales are always on a high, innovators always want to maintain this trend even though the product may be harmful to the market segment. Even though violent video games cannot harm teenagers directly, the effect that is being noted is psychological and behavioural alteration. Through engaging in these games, teenagers and children start aping and copying what the games portray, and this alters their behavior. What has been observed is that, aggressive behavior has been noted in those who engage in violent video games. Being young children and teenagers, one can only wonder what individuals are going to emerge from these aggressive personalities. Most researches as outlined above reveal that video games that contain violence continue impacting negatively on its users, especially children and teenagers. This is related to the time-frame for games and the level of violence compared to the age group. Young people spend an average of nine hours per day to play violent video games, and this time has been determined to be too much, thereby affecting them negatively. Moderation is necessary in games so that teenagers and children are not obsessed with violent games. Video games were created to be a form entertainment source, but not as a negative influence. In order for violent games to be purely a form of entertainment, then parents and guardians need to moderate the use to a few hours in a day. Children also need to be investigated so that they do not engage in games that belong to higher age groups. The human brain develops with time, and in every age group, there is a degree of what an individual can handle. The younger the indi vidual is, the more likely they are to be affected by violent games. Older children are able to handle violent games when compared to younger ones. For this reason, every game should be used by the age group that it is created with. When this is done, coupled with moderation on the time spent playing the games, then aggressive behavior will be reduced by those that engage in violent games. However, as long as this does not happen, then violent games will continue causing the development of aggressive behavior in people, especially young users. Something needs to be done to change this trend. Many products are being released into the market, and there is no one who has the right to control their release. People have the liberty to use products, but when these products start affecting users, then something needs to be done. Game manufacturers have the moral obligation to manufacture games that are not overly violent. But in a world where emphasis is on marketing and profit accumulation, no one can blame them. The onus is on parents to moderate game-time. Teenagers should understand that violent games correlate to aggressive behavior and moral decadence. They should restrain themselves and should treat games as merely an entertainment source and not as a behavior modifier. Parents will not always spend time with their children; hence, it reaches an age where teenagers need to do the right thing. Video games have become very popular in the contemporary world, and for parents it has become difficult for them to eliminate the games from their childrens lives. Research has shown that video games are important for children development. The problem comes in when they are overused and when young people play violent video games. These have been observed to cause aggression in young people. This research has proved that analogy. As it is difficult to eliminate videogames from the life of children and young people, the way to protect them is to reduce their negative effect through the following ways; a) Parents need to ensure that they are aware of the rating of the violent games played by their children. The ESRB considers the sex, violence, language and substance abuse contained in a game. From this, they give the age recommendation. Each game has a rating symbol for that particular age group b) Parents need to regulate internet usage in the homestead so that teenagers do not continually access violent games c) Parents need to set limits of video playing do that they do not overplay d) Parents need to monitor the media consumption of their children and guide them instead of according them too much freedom e) Guide children on the games they should play. A parent needs to take interest in video games so that they are able to offer guidance to children. Parents need to be free with their children and ask them about their feelings about the video games. By doing this, parents grow closer to their children. Therefore, the role of parents in curbing aggression in their children cannot be underemphasized. Psychologists have identified that parents have a role of cautioning their children concerning violent media. Stopping your children from engaging in violent video games is unrealistic as you cannot be with them all the time, but there is need to regulate what children engage in. There are many ways parents can help. For one, they need not install violent media at home. Secondly, parents need to know the rating of all video games available at home so that young children do not play games way above their level. Nevada on the Move of Importing Prescription Drugs

Assembly Majority Leader Barbara Buckley heads on the plan to import prescription medicines from Canada. Backed by other officials, cause-oriented groups, unions, doctor’s associations, and senior citizens, she together with other lawmakers, are now pushing to finalize the regulations to enable Nevadans to purchase drugs from Canadian drugstores which are lower-priced and more economical. The legislation is eyeing to implement the law by April 20 of this year. In line with this, Attorney General George Chanos has taken a stand to further modify the current rulings with regards the issue at hand. He said that possible federal Food and Drug Administration directives may be violated, resulting to legal consequences. Buckley, also the chief sponsor of the program, is headstrong to obtain the approval. She vows to work in achieving authorization as she claims to consider of her constituents who purposely go to Canada just to buy their daily medicinal needs. The final elements of the legislation are now being scrutinized by the board to meet the set deadline. These sections being worked on are the accreditation procedures of the Canadian pharmacies allowed to market medicines within the state. It is also required that these pharmacies have toll-free phone lines,   e-mail access, and the ability to get in touch with their customer’s doctor in cases the latter can’t present a valid prescription. The board is also looking at the guidelines as to when, where, and why the pharmacy can decline a purchase. The law also states that generic Canadian drugs can not be sold except when sold also in the same generic form in their country. The rules ensuring the safety of the drugs are being prioritized as well. The Canadian drugs cannot enter the state unless approved by the US Food and Drug Administration and Health Canada. It is assumed the people of Nevada will not only be benefited from the cheaper drugs that will soon be available to them. The regulation also aims to control unauthorized websites that are selling drugs to the US; drugs that are not tested safe and effective by the proper US health departments. The law also seeks to castigate agencies, companies, and individuals who are pursuing illegal prescription drugs importations within the constituency. It is not a secret that a lot of US citizens are actually flying to Canada or are getting their medicine from Canadian sources. Buckley aims to regulate these transactions, make it legal if it is, while still protecting the interests and rights of the people, particularly the Nevadans. Activists against the law on the other hand, would like to postpone the ratification until after every single detail is straightened out. They are pushing for lawmakers to launch a special session with regards this particular law. Those who on the pro-implementation side believe changes can be done in the regular legislative session next year. Feedback from individuals about her work is generally positive, but there has been a complaint from one service user who says he feels rushed and finds her manner rude. Jenna tells Fatima that she disapproves of some of his ways, which are against her beliefs, but had not realised that this showed in her attitude. Bi – Describe how Jenna should ensure that her personal attitudes and beliefs do not affect her work: Jenna needs to make sure that her personal believes are put aside, respecting the service users needs are more important than a personal opinion which may differ. Keeping work and personal life separate is crucial when working with others. Bii – Explain why it is important to reflect on your work activities: Reflecting on work activities is an important way for developing your knowledge and skills. Looking back on what you have done in the day will allow you to pick up on things you thought you could have done differently, find weaknesses and improve. When I first started in the caring industry I was lucky to have training in manual handling quite soon on, I was starting to feel my back hurting and finding it tricky to work together with the other carer when using the hoist/stand aid. After the training session I now know how to save my back from feeling the strain by make sure everything is in a good level reach and that communication when using the hoist and stand aid is important to both members of staff to reach the goal and for the service user to be safe. Cii – Think of an example of a time you have received feedback from others than has improved your knowledge, skills and understanding. This may have been from your assessor, tutor, a supervisor or line manager, or individuals using the service. Give a Description of feedback and how did this experience improve your knowledge, skills and understanding? When starting, feeding was one of my down falls. I used to get frightened I was going to choke someone, or course someone to aspirate. Whenever I could get information on individuals feeding habits I would make a point in asking. I would ask people for advice which really helped and would watch other people give feeding aid at lunch/dinner times. I received the best feedback on another carer when they showed me how they feed one individual, making sure you notice when they swallow. Ever since I have been more confident and I might still need improving in it, I do feel like I can safely feed someone.

Contract Law – Intention to Oontract

Contract Law 1 Intention to Create Legal Relations In order for a contract to be valid there must be intention to create legal relations. Enright notes ‘the requirement of intention to create legal relations is a final doorkeeper in contract. It determines which agreements supported by consideration shall be covered by contract law and which shall merely be morally binding. ’ This requirement was expressly stated for the first time in Heilbut, Symons & Co V Buckleton.Friel notes that important as there are a great many agreements and arrangements that, though possessing many of the characteristics of contract, probably are not intended to attract legal consequences. Intention to be legally bound operates on the basis of presumptions. The test for intention is objective. The court will impute intention to create legal relations to the parties on the basis on external factors rather than on the workings of the parties’ minds. Intention and Presumptions There are two presumptions in this area: 1.There is a presumption that agreements between family members or friends are not intended to be legally binding. 2. There is a presumption that agreements which are made in a commercial context are intended to be legally binding. Social and Domestic Arrangements A close family of social relationship raises a presumption of lack of intention to create legal relations. The seminal case, Balfour V Balfour involved maintenance payments to be sent home to his wife while he was working abroad. The court held that agreements between husband and wife are not intended to be legally binding.The closer the blood relationship the more readily the presumption will be raised and the more distant the degree of blood relationship, the more likely the courts will infer an intention to be legally binding. This can be seen in Simpkins V Pays where an informal agreement between a landlord and his lodger, to enter into a weekly competition, held lodger entitled to share of winnings, despite landlord’s evidence that there was no intention to be legally bound. Rogers V Smith shows the same principal in Balfour V Balfour applied to other family relationships. It was held in this case that the agreement between a mother nd her son did not attract legal relations. Likewise in Mckay V Jones where a nephew had worked on his uncle’s farm for some years without payment, claimed that the uncle had promised to the farm when he died. Deale J. Ruled that it was nothing more than a statement of intention or wish by the deceased†¦.. no promise was made as the agreement was between family members. In contrast to this case is McCarron V McCarron where a child worked without reward for 16 years. The child was said to have lost out more in McCarron and therefore had a greater detriment or reliance on the compensation promised.The dates between this cases may explain the different points of view. In Leahy V Rawson found that an agreement between her no n-marital partner’s brother, did not attract the presumption as it only applies to the closest family kinships, such as parent and child and spouses. The courts also held the same principal in social arrangements as was shown in Hadley V Kemp. In this case the court raised the presumption that an agreement as to the sharing of songwriter’s loyalties with other members of his band (Spandau Ballet) was not intended to create legal relations.Enright notes that a degree of intimacy is required between the parties in order to raise the presumption. The issue is not of status but closeness. We can contrast Balfour with Merritt V Merritt. As in Balfour, the parties were husband and wife and the agreement concerned an allowance, yet, in Merritt, the court chose to enforce the agreement. Merritt is distinguished however, on the grounds that the husband and wife were separated, so they were not in a close relationship any longer and so the presumption of lack of intention to cre ate legal relations could not be raise.For the same reason, and as it appears in Courtney V Courtney, a separation agreement will not attract the presumption of lack of intention to create legal relations. It is the parties’ relationship at the time of contracting which matters. That is clear from the mother-daughter case of Jones V Padavatton. In this case, the mother agreed to maintain her daughter if she came home and studied for the Bar. Over time their relationship broke down but the presumption of lack of intention to create legal relations stood because of their close relationship at the time. Rebutting the PresumptionThere is some authority to the effect that the courts are more likely to find that the presumption of lack of intention to create legal relations has been rebutted where one party has relied on the agreement. This is seen in Parker V Clarke, involved two couples who were close friends. The Clarks told the Parkers if they sold their cottage they could move in with them, that the Clarks would leave some of their considerable estate to the Parkers on his death. Sometime after the couple moved in they fell out and the Parkers were forced to move out. They sued the Clarks for breach of contract.Because of the parties close relationship at the time of contracting, the presumption was that it was not intended to be legally binding. However, the court found that the Parkers’ detrimental reliance on the agreement in leaving their home was a factor strong enough to rebut the presumption, and intention to create legal relations was thereby found. The party alleging that a family agreement was intended to be legally binding bears the onus of rebutting the presumption that it was not so intended. It is significant that in a family agreement was made in a business context.So, for example, an agreement made in connection with a family business, such as that between brothers, directors of the company in Snelling V John G Snelling Ltd, is unl ikely to fall foul of the presumption of lack of intention to create legal relations. The words used by the parties in setting out their agreement and, in particular, the level of certainty attaching to the agreement were also important. The fact that the parties have taken time to set out their agreement with formality and precision suggests that they intended it to be legally bound.On the other hand, where an agreement is expressed in vague terms, it tends to suggest that the parties did not intend to create a legally binding agreement. This is clear from Vaughan V Vaughan. This case concerned a couple who were no longer living in amity. They had agreed that the wife could stay in the matrimonial home. However, they had not decided how long she could stay for, or on what terms. Accordingly, their agreement was so vague in its essentials that the Court could not confer intention to create legal intentions in it.Commercial Agreements Commercial agreements raise the presumption that intention to create legal relations is present. It is difficult to rebut this assumption. The burden of proof is on the party seeking to deny it and that burden, according to Edwards V Skyways, is a heavy one. Vagueness on the essential terms of the contract tends to suggest an absence of intention to create legal relations. For example, the courts will rarely be able to find intention to create legal relations in so-called sales puffs.Thus, in Lambert V Lewis, no contract arose from a manufacturer’s statement that his product was ‘foolproof’ and ‘required no maintenance’ because his statements were ‘not intended to be, nor were they, acted on as being express warranties’. A lot depends on the facts of the case at hand. In Esso Petroleum V Commissioner of Customs and Excise, a binding contract was deemed to arise from a transaction in which football tokens were offered to anyone who purchased four gallons of the plaintiff’s petrol .According to Lord Simon ‘†¦. the whole transaction took place in a setting of business relations†¦Ã¢â‚¬â„¢, the purpose of the offer being commercial: Esso wanted the public to buy its petrol. Rebutting the Presumption Cadbury Ireland Ltd V Kerry Co-Op shows how a number of factors can operate to rebut the presumption of intention to create legal relations. In this case, a clause held not intended to be legally binding despite its solemnity: it was an argument to draw up a detailed agreement, but could not be relied upon itself.Even in a commercial context, the presumption in favour of the intention to create legal relations can be dispatched by a very clear expression of lack of intention. A classic example of this is in Rose and Frank Co V Crompton Bros. In this case, the parties had agreed that the plaintiff would be permitted to distribute the defendants’ goods in the US. The agreement however contained an ‘honourable pledge clause’. The cour t held that the agreement could not be enforced because of this clause. The court also found the wording precise enough to rebut the presumption in Jones V Vernon’s Pools Ltd.Collective Agreements Where a trade union negotiates an agreement with an employer on behalf of its members, does this agreement attract the presumption of intention to create legal relations? In the English case of Ford Motor Co Ltd V Amalgamated Union of Engineering and Foundry Workers, it is said that the presumption in relation to collective agreements is that they are not made with the intention to create legal relations. However, Irish Law takes a contrary view, tending to favour the enforcement of collective agreements via contract.So in Ardmore Studios V Lynch, it was suggested that a collective agreement which is set out in a clear specific manner will take legal effect. The Supreme Court took up this thread in Goulding Chemicals V Bolger. For the purposes of Irish Law, it seems safe to say that collective agreements can be enforced in the same manner as any other commercial agreement and attract the presumption that the intention of legal relations is present. In O’Rourke V Talbot Ireland, Barrington J treated a collective agreement as a commercial agreement.Similarly, in King V Aer Lingus the Supreme Court took the view that some of the commitments given by Aer Lingus to its employees as part of a collective agreement were binding. A problem that continues to afflict collective agreements, however, is their characteristically vague language – the majority of collective agreements will be void for uncertainty. Letters of Intent V Letters of Comfort Enright notes that a letter of comfort is a document designed to reassure the person to whom it is provided about certain matters while stopping short of making any binding promise.A good example of the effects of a letter of comfort arose in Kleinwort Benson V Malaysia Mining Corp. Bhd. In this case, the plaintif f bank had agreed to lend money to the subsidiary of the Malaysia Mining Corporation. In the course of negotiations for the loan, the bank received a letter of comfort stating that: ‘it is policy to ensure that the business of our subsidiary is at all times in a position to meet its liabilities to you under the above arrangements. ’ Despite this reassurance, the Court of Appeal concluded that this statement did not bind the defendant.The letter was not, in fact, purporting a binding promise. It was simply stating that company’s policy, a policy that might be changed or adjusted in response to novel circumstances. It is important to note, however, that there is no concrete rule precluding a letter of comfort from giving rise to legal relations. Whether or not such letters creates a legally binding promise is a matter to to be discerned primarily from the language used. The simple fact that the words ‘letter of comfort’ have been used, while evidently relevant, may not conclusively prevent the agreement rom having legal implications. There is a lot of uncertainty in this area as in seen in the case of Wilson Smithett & Cape (Sugar) Ltd V Bangladesh Sugar and Food Industries Corporation. A letter of intent, in contrast to a comfort letter, is one in which a person or company seeks to induce another entity to undertake work to incur expenditure, while denying or limiting liability to that other entity, often by insisting that liability turned on concluding a formal contract at a later date.In AC Controls Ltd V BBC, the court summarised the principals in relation to letters on intent. The general principal on letters of intent that seek to authorise work, materials or services pending the conclusion of a later contract is that such letters will be viewed as contracts in themselves as long as objective is present. In ERDC Group Ltd V Brunel University, the Court held that the work done prior to September had all been on the authority as set out in the series of Letters of Intent.The judge thought that the usual requirements for a contract were all there (intention to create a legal relationship, certainty, etc) and had all been there until 1 September. He therefore found that there had been a contract until then. Accordingly, ERDC was to be paid on the basis specified in the letters – the JCT rules. Conclusion It is contended that the requirement of intention to create legal intentions largely makes sense.Social and domestic agreements have the presumption as not having intention to create legal relations as there is a belief that such formalities are not required in this type of relationship. Enright notes that there are two reasons why this is employed. Firstly, if the rule were that social and domestic agreements were always legally binding, the courts might be flooded with petty disputes and the second is because it is felt that people should have the freedom to make certain types of private, persona l agreements without drawing the interference of the law into their lives.It is also understood that Commercial Agreements are correct as they do have the intention to create legal relations as there is the acceptance that such formalities should be required in this type of relationship. The ways to rebut this assumption also makes sense as it can be rebutted if the essential terms of the contract are vague or if the party seeking to deny it can prove that there was no intention. Enright notes the burden of proof is on the party seeking to deny it and that burden according to Edwards V Skyways, is a heavy one.
